The Latest Update On The Menendez Brothers Case

From the outside looking in, the Menendez family appeared to be an average family. Jose Menendez was a music executive who signed acts like Duran Duran and Menudo, allowing his family to move across the country and settle down in Beverly Hills, California. Jose’s wife, Kitty, managed the family household while their two sons, Erik and Lyle, attended school.


But life in the Menendez household was not what it seemed. According to the Menendez brothers, their father was sexually abusive and their mother was complicit. On one fateful day in 1989, Erik and Lyle entered their home with two shotguns and killed their parents. 

Recently, the Menendez brothers were resentenced, providing the pair an opportunity to be released on parole

The Menendez Brothers’ Original Trial

In 1993, the brothers went to trial for the murder of their parents. Their defense detailed some of their sexual abuse at the hands of their father, while the prosecutors claimed that the brothers’ actions were motivated by their family’s money. Unfortunately, a mistrial was declared due to a deadlocked jury. 

 

 

When the Menendez brothers returned to the courtroom in 1996, their case was not as strong — the judge did not allow the defense to present the majority of evidence that indicated the brothers were being abused by their father. Their second trial resulted with Erik and Lyle receiving life in prison without parole. 

New Evidence Revealed

After a few decades in prison, the Menendez brothers filed a habeas corpus to present new evidence to the court and challenge their “life without parole” conviction. While the Los Angeles district attorney asked the court to reject the brothers’ habeas corpus filing, the presiding judge felt the new evidence was substantial enough to review. 

During their original trial, a relative of the Menendez brothers testified that Erik had written them a letter describing his father’s abuse before the murders occured. However, the physical evidence (the letter itself) was missing. Since the 90s trials, the relative found the letter to be submitted as evidence. 

But the biggest revelation in the Menendez brothers case came in 2023, when former Menudo member publicly revealed that Jose Menendez had drugged and raped him at 13 years old. This is the first time someone other than Erik and Lyle reported that their relationship with Jose was sexually abusive in nature. 

Outpouring Of Community Support

After 35 years in jail, Erik and Lyle Menendez have helped other fellow prisoners rehabilitate and abstain from further legal trouble. Anerae Brown, who had been incarcerated in the same prison as the brothers, credits the pair for helping him during his time away. He expressed to the judge “I have children now. Without Lyle and Erik I might still be sitting in there doing stupid things.”

 

 

Former judge, Jonathan Colby, also spoke highly of the brothers. After getting to know the pair, Colby indicated they helped him understand how prison rehabilitation programs can be successful for incarcerated individuals. 

Additionally, various members of the Menendez family supported the brothers’ bid for parole, with one relative stating, “We all, on both sides of the family, believe that 35 years is enough. They are universally forgiven by our family.”

Given all the new evidence and statements of support, the presiding judge re-sentenced Erik and Lyle to 50 years to life with the possibility of parole. 

Upcoming Legal Proceedings 

The Menendez brothers and their legal team are not done yet — Erik and Lyle will need to undergo a risk evaluation and their case will be presented to the parole board. This process could take any length of time and the brothers will remain in prison until their parole request is granted.
