Declaring Indigency In Legal Proceedings

This week, the trial against David Anthony Burke (musician D4vd) has taken a surprising, unexpected turn: Burke replaced his defense attorneys with a public defender due to financial hardship. In the courtroom, when an individual has a significant financial burden and cannot afford representation, they can claim indigency and ask for a court-appointed legal counsel, like Burke.

owever, Celeste Riva Hernandez’s body was found within an abandoned Tesla registered to Burke. The musician was actively on tour when police discovered her body. Burke has earned millions from his music sales. So, claiming indigency and receiving a public defender seems odd in this context.

But the information presented to the judge was enough to grant Burke’s wish for a public defender. Let’s review the legal definition of indigency and the constitutional right for representation. 

What Does Indigent Mean?

According to the law, everyone has a right to fair trial, which means if an individual cannot financially afford legal aid, there is a system in place to obtain court-ordered representation. During the initial hearing, an individual must inform the judge that they cannot afford legal counsel. 

From here, the defendant will need to follow state-specific rules to receive a court-appointed attorney, otherwise known as a public defender. The judge will take into account the severity of the crime as well, given that legal counsel will be more costly for individuals facing serious criminal charges. 

If a judge determines that an individual would not be able to afford representation given their current financial status, they are declared indigent and will receive a public defender. 

The Wrong Place, The Wrong Time, But Too Poor To Fight

The landmark ruling for indigency came from the Supreme Court in 1963 in Gideon v. Wainwright. Gideon was arrested for breaking and entering based on eyewitness testimony placing him near the scene. When he requested a court-appointed lawyer, it was denied in Florida. At the time, FL would only provide counsel for defendants facing the death penalty.

When Gideon was convicted, he spent his time in prison writing an appeal for his case on the grounds that his 6th amendment right had been violated. In 1963, the U.S. Supreme Court agreed that Gideon had his civil rights violated when he was denied legal representation. When Gideon was given a retrial with an attorney, the jury voted to acquit Gideon of the former charges. 

How Did D4vd Qualify For Indigency?

Now, something seems off. It’s understandable how a man like Gideon would be declared indigent, but a rising musician who was paid over 10 million dollars (according to testimony from D4vd’s financial manager) and was actively touring across the country? 

Unfortunately, the public is not privy to the financial details of Burke’s legal expenses. According to the Los Angeles public defender’s office, they thoroughly reviewed the situation and decided “...David Burke is eligible for representation.” 

Attorney of the Rivas Hernandez slammed the decision to declare Burke indigent, “The residents of Los Angeles County should be outraged because it will be the taxpayers that are picking the tab to defend this millionaire on charges of murder, continuous sexual assault of a minor under 14 years of age, and unlawful mutilation of human remains.” 

As the case continues on, it will be interesting to see if recent purchases by Burke’s parents will be questioned, as both individuals made financial moves ahead of Burke’s claim of indigency. However, the request for a public defender was granted, so moving forward, Burke will have court-appointed representation.
